Mumbai: The Bombay High Court on Tuesday issued a showcause notice to Maharashtra Minister and NCP’s chief spokesperson Nawab Malik asking him to explain why should not an action be taken against him for breaching undertakings given to the court and for continuing to defame IRS officer Sameer Wankhede for “breaching” his undertakings to the court and continuing to make defamatory statements against IRS officer Sameer Wankhede.

Two months after Malik filed an affidavit tending an “unconditional apology” to the Bombay High Court for ‘breaching’ his undertaking to the court that he would refrain from making statements against Sameer’s father Dhyandev Wankhede and his family members, a HC bench of Justices SJ Kathawalla and Milind Jadhav passed an order on a contempt petition filed by Dnyandeo Wankhede, alleging ongoing defamation.

Alluding to Malik's affidavit filed on December 10 wherein he had disputed the veracity of the press conference transcripts, the HC bench said that the NCP minister should have produced the “correct statements” on record in that case.

"We are therefore not satisfied with the explanation given by Respondent No 1  (Nawab Malik)," the HC bench said,  as it directed the High Court registry to issue the show-cause notice under Rules to



Regulate Proceedings for Contempt under Article 215 of the Constitution of India and the Contempt of Court Act 1971. The notice is returnable on February 21.

It may be recalled that in an affidavit filed by him on December 10,. 2021 in response to an explanation sought from him by the high court on December 7 as to why a contempt of court notice should not be issued against him for deliberately breaching his assurance to the court, Malik had tendered an “unconditional apology” t the same HC bench of Justices Kathawalla and Jadhav for breaching an undertaking given to the court.

“I tender my unconditional apology to this Honourable Court in respect of the breaches of my undertaking given to this Court as recorded in the orders dated November 25 and November 29, 2021. I had no intention to disrespect, dishonour, overreach or breach the said order,” Malik had stated.

Malik had told the court that the statements were made during the course of media interviews with journalists on several topics over a considerable period of time.

The Minister said that the responses given by him during the course of interviews were made with a belief that they were not covered by the undertaking given by him to the High Court.
