Bandi Sanjay moves high court to quash SSC paper leak case

Justice Anil Kumar Jukanti of the Telangana High Court on Tuesday heard the criminal petition filed by Union Minister of State for Home Affairs, Bandi Sanjay Kumar, seeking to quash the case registered against him in the alleged SSC question paper leakage incident.

Senior Counsel L. Ravichander, appearing for the petitioner, submitted that the complaint did not disclose any ingredients to attract the offences alleged, either under the IPC or the State Malpractices Act. He argued that the provisions of the 1997 Act were not applicable to the petitioner in any manner.

He contended



that even as per the prosecution’s version, the alleged leakage occurred after the commencement of the examination, and the narrative of someone scaling the compound wall, taking photographs of the question paper, and circulating them, was ‘more fiction than fact’.

During the hearing, Justice Anil Kumar questioned the Public Prosecutor on several aspects, particularly on whether the provisions of the Malpractices Act could be invoked against the petitioner based on the material placed on record. At the request of the Public Prosecutor, the matter was adjourned to November 17 for further arguments.
